Purpose and legal grounds for the processing of personal data<\/p>\n<p>&nbsp;<\/p>\n<p>We only ever process personal data for a specified purpose and to the extent it is necessary.<\/p>\n<p><strong>Contracts and pre-contractual measures<\/strong><br \/>\nThe processing of personal data for the purpose of supplying goods and services to data subjects and the processing of personal data for the purpose of the performance and negotiation of contracts to which a data subject is party and fulfilling contractual obligations and rights (e.g. invoicing, debt collection as well as contract or supply negotiations and communications) are based, where applicable, on the performance of a contract between the data subject and the controller or the implementation of pre-contractual measures.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Legitimate interest<\/strong><br \/>\nThe data controller\u2019s or a third party\u2019s legitimate interest is the basis for processing personal data for the purpose of management and maintenance of customer and supplier relationships, communications, customer satisfaction surveys and brand surveys, sales and marketing activities (including telephone marketing and other types of direct market-ing, marketing plans and follow-ups) as well as the development of business operations, analytics and reporting. Processing related to the manufacture, supply and sale of products and services as well as other contractual matters and marketing related to the recip-ient\u2019s area of responsibility in the company they work for is also based, where applicable, on the legitimate interest of the controller or that of a third party.<\/p>\n<p>&nbsp;<\/p>\n<p>When we process personal data on the basis of legitimate interest, we weigh up the ad-vantages and potential disadvantages of the processing for data subjects and ensure that the data subjects\u2019 rights and interests do not override the legitimate interest. The data subjects have, however, the right to object to the processing of their personal data based on a legitimate interest by presenting the grounds relating to their particular situation. In a case such as this, we will assess whether there is a substantial and valid reason, despite the objection, to override the data subject\u2019s interests, rights and freedoms, or whether the processing is permitted on other grounds under the General Data Protection Regulation. However, data subjects always have the right to object to the processing of their personal data for the purposes of direct marketing. Personal data may also be processed to detect misconduct and to protect property and the safety of individuals. In these cases, the processing of personal data may be based on a contractual relationship, compliance with a legal obligation or a legitimate interest.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Consent<\/strong><br \/>\nPersonal data may be processed for any purpose for which the data subjects have given their consent. For example, electronic direct marketing to data subjects requires their consent. Regular sources of data<\/p>\n<p>&nbsp;<\/p>\n<p>Personal data are mainly collected from the following sources:<br \/>\n\u2022 Information provided by the data subjects themselves through the website, social media, phone, subscription or through another type of contact\/channel (privately held source)<br \/>\n\u2022 The Group\u2019s customer register (privately held source)<br \/>\n\u2022 Contact persons\u2019 details obtained from Suomen Asiakastieto\u2019s decision-maker register, companies\u2019 public websites, social media or similar registers<br \/>\n\u2022 Feedback and offer request forms (privately held source)<br \/>\n\u2022 Notes from meetings (privately held source)<br \/>\n\u2022 Public websites such as ytj.fi<\/p>\n<p>&nbsp;<\/p>\n<p>6. Disclosure of personal data and recipients<\/p>\n<p>&nbsp;<\/p>\n<p>We may use third parties when processing personal data (e.g. accounting firm, installation services, IT support and communications services).We have contracts required by data protection legislation in place with such parties.<\/p>\n<p>&nbsp;<\/p>\n<p>Personal data may be transferred within EcoUp Group and between the Group companies for the purposes described in this privacy statement and in compliance with data protection legislation.<\/p>\n<p>&nbsp;<\/p>\n<p>Personal data may be disclosed to the authorities as required by law. In the event of an emergency or other unforeseen circumstances, we may have to disclose personal data in order to protect life, health and property. We may also be required to disclose data sub-jects\u2019 personal data if a Group company is involved in litigation or other dispute settlement proceedings. Moreover, if EcoUp Group or the Group companies become involved in a merger, acquisition or other arrangements, it may be required to disclose personal data to third parties.<\/p>\n<p>&nbsp;<\/p>\n<p>7. Transferring personal data outside the EU or the EEA<\/p>\n<p>&nbsp;<\/p>\n<p>As a rule, we process personal data in the EU and the EEA, but data may also be processed outside these areas. If personal data are transferred outside the EU or the EEA, we will provide an adequate level of data protection using the standard contractual clauses approved by the EU Commission.<\/p>\n<p>&nbsp;<\/p>\n<p>We can provide further information about transferring personal data and the transfer mechanisms.<\/p>\n<p>&nbsp;<\/p>\n<p>8. Data retention periods and criteria<\/p>\n<p>&nbsp;<\/p>\n<p>\u2022 As a general rule, personal data are processed for the duration of the consumer\/corporate customer relationship. Data related to customers are, however, processed for a maximum of ten (10) years after the last contact or transaction, taking into account any potential complaints and liabilities for defects.<br \/>\n\u2022 For marketing purposes, customers\u2019 and potential customers\u2019 contact details are processed for as long as we target marketing efforts at them or for as long as we contact them about certain services or products and they have not objected to the processing of their personal data for the purposes of direct marketing or, if the direct marketing efforts are based on consent, they have not withdrawn their con-sent. We retain contact details that we use in telemarketing for a maximum of 12 months.<br \/>\n\u2022 We process personal data related to sales and consumers for as long as the con-tract or project are valid.<br \/>\n\u2022 Personal data processed on the grounds of legal obligations are processed and retained for the period of time determined by law.<\/p>\n<p>&nbsp;<\/p>\n<p>Not withstanding the foregoing, personal data may be retained for as long as necessary if they are required for the settlement of a complaint or similar or in relation to litigation. Automated decision-making and profiling<\/p>\n<p>&nbsp;<\/p>\n<p>We do not use data for automated decision-making or profiling that would have a legal or similarly significant effect on data subjects.<\/p>\n<p>&nbsp;<\/p>\n<p>10. Joint controllership related to Facebook services<\/p>\n<p>&nbsp;<\/p>\n<p>When we maintain company pages on Facebook, Facebook and the controller referred to in this privacy statement are, where applicable, and in accordance with data protection legislation, joint controllers of the personal data of the visitors to said Facebook page.<\/p>\n<p>&nbsp;<\/p>\n<p>Facebook processes personal data according to its own data policy, which you can read here. Facebook is responsible for complying with its obligations under data protection legislation and the implementation of data subjects\u2019 rights in its service. Principles of protecting personal data<\/p>\n<p>&nbsp;<\/p>\n<p>We protect personal data using appropriate technical and organisational measures. We aim to guarantee that our systems work and that personal data can be restored even in the event of a fault.<\/p>\n<p>&nbsp;<\/p>\n<p>The data are stored appropriately on secure servers with technical data security that is controlled by several different means. Access to the data is managed by job role-based management of access rights.
